Terms of Service
1. Agreement to these Terms
These Terms of Service (“Terms”) are a binding agreement between you and the operator of Towly (“Towly,” “we,” “us,” or “our”) governing your access to and use of the Towly mobile application and related services (the “App” or “Service”).
By using the Service, you agree to these Terms, our Privacy Policy, and our EULA. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service.
3. What Towly is — informational only
Towly is a community-driven app for reporting and avoiding predatory-towing areas. Reports, parking checks, alerts, maps, and related information are provided for informational purposes only.
Towly is not an official parking authority, tow company, municipality, law-enforcement agency, insurer, or legal advisor. We do not guarantee accuracy, completeness, or timeliness.
Always follow posted signage, meters, permits, and local laws.
4. No liability for towing, tickets, or reliance
YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOWLY AND ITS OPERATORS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS HAVE NO LIABILITY FOR:
- Any towing, booting, impound, storage, release, or related fees or costs.
- Any parking tickets, citations, fines, penalties, or enforcement actions.
- Any damage to, loss of, or theft of a vehicle or property.
- Any decision based on community reports, alerts, maps, or parking checks.
- Inaccurate, outdated, incomplete, false, misleading, or missing content.
- Failed, delayed, or missed alerts or notifications.
- Acts or omissions of tow companies, property owners, municipalities, or other third parties.
5. Accounts and acceptable use
You are responsible for activity under your account. Submit only truthful reports. Do not post false, defamatory, harassing, or unlawful content; do not upload others’ private information without consent; do not misuse or disrupt the Service.
6. Your content
You retain ownership of content you submit and grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use it within the Service’s community features. You are solely responsible for Your Content.

8. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOWLY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY TOWING COSTS, IMPOUND FEES, PARKING TICKETS, FINES, VEHICLE DAMAGE, OR LOSSES FROM RELIANCE ON SERVICE CONTENT.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF: (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM; OR (B) USD $10.00.
THESE LIMITATIONS ARE AN ESSENTIAL BASIS OF THE BARGAIN. NOTHING HERE EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
10. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Towly and its operators from claims arising out of Your Content, your use of the Service, or your reliance on Service content without independent verification.
11. Termination
You may delete your account from Settings → Delete My Account. We may suspend or terminate access for Terms violations or if we discontinue the Service.
12. Governing law
Except where prohibited by mandatory local law, these Terms are governed by the laws of the State of Delaware, United States. Consumers in the EEA/UK may bring proceedings in their country of residence where required.
13. Apple App Store terms
These Terms are between you and us, not Apple. Apple has no maintenance obligation. Apple and its subsidiaries are third-party beneficiaries.
