Towly
End User License Agreement
1. Agreement between you and Towly
This End User License Agreement (“EULA”) is between you and Towly (“we,” “us”). By downloading or using Towly you agree to this EULA, our Terms of Service, and our Privacy Policy.
This EULA is between you and Towly only, not Apple Inc. (“Apple”).
2. License
We grant you a non-transferable, non-exclusive, revocable, limited license to install and use the Application on Apple-branded devices you own or control, as permitted by the Apple Media Services Usage Rules, for personal use only.
3. Restrictions
You may not copy, reverse engineer, modify, rent, sell, redistribute, or sublicense the Application except as permitted by law. Do not submit false reports or misuse community features.
4. Informational use only
Community reports and alerts are informational only and not official guidance. Towly does not warrant accuracy or timeliness. You must verify posted signs and local rules yourself.
5. Maintenance and support
Towly, not Apple, is solely responsible for maintenance and support. Contact Contact us.
6. Warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. If a non-disclaimable warranty fails, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation.
7. Product claims and IP
Subject to the liability limits in this EULA and the Terms of Service, Towly — not Apple — addresses product claims and third-party IP claims relating to the Application.
8. Legal compliance and Apple beneficiary
You represent you are not in an embargoed country and not on a restricted-party list. Apple and its subsidiaries are third-party beneficiaries of this EULA.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOWLY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR TOWING COSTS, TICKETS, FINES, VEHICLE DAMAGE, OR RELIANCE ON COMMUNITY CONTENT.
TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF AMOUNTS YOU PAID US IN THE PRIOR 12 MONTHS OR USD $10.00. Nothing excludes liability that cannot be excluded under applicable law.
10. Termination
This EULA ends if you or we terminate it, or automatically if you fail to comply. Stop using and delete all copies upon termination.
